CMC MARKETS NZ LIMITED X THE BLUES 2026 SPONSORSHIP GIVEAWAY PROMOTION TERMS AND CONDITIONS

Introduction

1.     These terms and conditions (“Terms”) form the basis of the CMC Markets NZ Limited x The Blues 2026 Sponsorship Giveaway Promotion (“Promotion”). Entry into this Promotion constitutes acceptance of these Terms.

2.     Blues Limited Partnership (number 2582082) of 32 Campbell Crescent, Auckland 1051 ("Blues Rugby”) and CMC Markets NZ Limited (company number 1705324) of Level 39, 23 Albert Street, Auckland 1010 ("CMC Markets NZ”) are each promoters of this Promotion ("Promoters”).

Promotion Period

3.     The Promotion comprises several periods as follows, which will open at:

(a)     12:00PM NZDT on 5 February 2026 and end at 11:59PM NZDT on 10 February 2026 (“First Promotion Period”);

(b)     12:00AM NZDT on 25 February 2026 and end at 11:59PM NZDT on 3 March 2026 (“Second Promotion Period”);

(c)     12:00AM NZDT on 5 March 2026 and end at 11:59PM NZDT on 11 March 2026 (“Third Promotion Period”);

(d)     12:00AM NZDT on 18 March 2026 and end at 11:59PM NZDT on 24 March 2026 (“Fourth Promotion Period”);

(e)     12:00AM NZDT on 7 April 2026 and end at 11:59PM NZST on 13 April 2026 (“Fifth Promotion Period”); and

(f)      12:00AM NZST on 6 May 2026 and end at 11:59PM NZST on 12 May 2026 (“Sixth Promotion Period”),

together referred to in these Terms as the “Promotion Periods” and individually as a “Promotion Period”.

4.     The Promoters reserve the right to delay, shorten, extend or otherwise amend the duration of any Promotion Period without notice.

Conditions of Eligibility

5.     Entry is open to all persons who are New Zealand residents, excluding:

i.             persons under 18 years of age;

ii.            management, employees and contractors of a Promoter or a related party of a Promoter and their immediate family members;

iii.          management, employees and contractors of SANZAR Pty Limited (Australian Business Number 31 069 272 304) or any other entity responsible for managing the ‘Super Rugby Pacific’ competition and their immediate family members; and

iv.           management, employees and contractors of other agencies, firms or companies associated with this Promotion and their immediate family members.

Each person who satisfies the eligibility criteria set out in this clause 5 is an eligible entrant (“Eligible Entrant”).

6.     To be eligible to be selected as a winner, an Eligible Entrant must, during the relevant Promotion Period:

(a)     access the entry form by scanning a QR code:

i.        included in the Blues Rugby electronic direct mail campaign which Eligible Entrants will receive at the start of the relevant Promotion Period; or

ii.       displayed on the Blues’s official Facebook and Instragram; ("Entry Form”);

(b)     Spin a branded digital “Spin-to-Win” wheel for a chance to enter the draw to win the Prize;

(c)     subject to an Eligible Entrant agreeing to the CMC Markets NZ Privacy Statement, located at https://www.cmcmarkets.com/en-nz/privacy, and to the use of their personal information by CMC Markets NZ, including for the purposes disclosed as the proposed use of such information, provide all requested personal details on the Entry Form;
(d)     read and consent to these Terms and any other relevant legal documentation as specified on the Entry Form; and

(e)     complete and submit the Entry Form.

7.     The Promotion is limited to one spin per Eligible Entrant in each Promotion Period.

8.     Entries will be deemed to be accepted at the time of receipt and not at the time of transmission.

9.     Entries will be deemed invalid if they breach these Terms as determined by the Promoters at their sole discretion or any other instructions or guidelines notified by the Promoters during the entry process for the Promotion. This includes, without limitation, incomplete or illegible entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights.

10.  Any Eligible Entrant who, in the opinion of the Promoters, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.

11.  Entry is free. No purchase or payment is required to participate.

Winner selection

11.  Winners will be selected by an automated random selection tool built into the CampaignWare platform to ensure a fair process.

12.  Each winner will be selected at random from all eligible entries received during the Promotion Period.

13.  The Promoters’ decision is final and no correspondence will be entered into.

The Promotion

14.  The draw date for the:

(a)     First Promotion Period is 11 February 2026;

(b)     Second Promotion Period is 4 March 2026;

(c)     Third Promotion Period is 12 March 2026;

(d)     Fourth Promotion Period is 25 March 2026;

(e)     Fifth Promotion Period is 14 April 2026; and

(f)      Sixth Promotion Period is 13 May 2026,

together referred to in these Terms as the “Draw Dates” and individually as a “Draw Date”.

15.  The Draw Dates may be changed by the Promoters at their absolute discretion. All Eligible Entrants will be notified of such changes.

16.  On each Draw Date, five Eligible Entrants will be selected at random from the relevant pool of Eligible Entrants who satisfy the criteria set out in clause 6 above as the winner and will be eligible to receive the Prize (as defined in clause 19 below) (together the “Winners” and each a “Winner”).

17.  Winners will be contacted by email from Blues Rugby on the relevant Draw Date using the email address provided on the Entry Form and Prizes (consisting of digital tickets) will be sent via email in PDF format. Once the Prize has been dispatched to a Winner, the Promoters take no responsibility for any technical issues affecting email delivery, including incorrect email addresses supplied by entrants.

18.  The selection of the Winners in this Promotion is final and binding.

19.  Each Winner will receive one prize as part of the Promotion comprising two general admission tickets to the next Blues match worth NZD$68 per ticket to be held at Eden Park (located at 42 Reimers Ave, Kingsland, Auckland 1010, New Zealand) after the relevant Draw Date ("Prize”). There will be five Winners in each Promotion Period. The total prize pool for the Promotion is worth NZD$ 4,080.

20.  The Prize cannot be transferred, exchanged or redeemed for cash, other prizes or any other value.

21.  It is a condition of accepting the Prize that a Winner must comply with all the conditions of use of the Prize and each Promoters’ requirements.

22.  Prize values are based upon the recommended retail prices at the time of printing or publication of these Terms (inclusive of GST). The Promoters accept no responsibility for any change in Prize value between now and the ultimate Prize redemption date.

23.  If, for any reason whatsoever, a Winner does not take an element of the Prize at the time stipulated by the Promoters, then that element of the Prize will be forfeited by the Winner and cash (or any

substitute prize) will not be awarded in lieu of that element of the Prize. If the forfeited element of the Prize impacts the ability of the Winner to accept any other elements of the Prize, such other elements of the Prize may be forfeited as a result.

24.  The Promoters are not responsible for the cancellation, delay or rescheduling of any part of the Prize and any resulting costs incurred by the Winner or any companion(s) (if applicable) will be the responsibility of the Winner and/or companion(s) (if applicable).

25.  The Promoters reserve their right to substitute the Prize for an alternative prize of equal or similar value, in the event that, the Prize is not available due to circumstances outside of either Promoter’s control.

26.  The tickets are only valid for the date or period specified on the tickets or by the ticket providers, and are subject to any terms and conditions imposed by the ticket provider including but not limited to any conditions of entry into the relevant event location. The Winner (and any companion(s), if applicable) must make their own way to and from the relevant event location at their own cost. Any additional costs incurred in relation to using the tickets, including but not limited to any food/beverage costs or transfer costs are the responsibility of the Winner and any companion(s).

27.  If one of the people participating in the Prize is under the age of 18 years, a parent or legal guardian must be present for the duration of the Prize as one of the participants.

28.  The Promoters reserve the right to refuse to allow a Winner to take part in any or all aspects of the Prize, if either Promoter determines, in their absolute discretion, that a Winner is not in the mental or physical condition necessary to be able to safely participate in the Prize.

Legal

26.  All persons taking part in the Promotion, to the maximum extent permitted by law, release from, and indemnify CMC Markets NZ against, all liability, cost, loss or expense arising out of or in connection with the Promotion including (but not limited to) personal injury and damage to property and whether direct or consequential, foreseeable, due to any negligent act or omission or otherwise.

27.  If requested by a Promoter, a Winner (and their companion(s), if applicable) must sign (or procure that their parent/guardian signs) an indemnity and exclusion of liability form provided by the Promoter, in favour of the Promoter and all parties involved in this promotion and/or providing the Prize, before they participate in the Prize. If they or their parent/guardian do not sign that form within the time specified by the Promoter, they will not be able to participate in the Prize and the relevant Winner’s entry or claim will be deemed invalid.

28.  No responsibility will be accepted by the Promoters for any problems or technical malfunction of any communication network or any for lost, late, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.

29.  Neither Promoter is responsible for technical difficulties with the entry mechanism and neither Promoter warrants that the entry mechanism will be available at all times during the Promotion Period.

30.  Neither Promoter is liable for any consequences of user error including (without limitation) any costs incurred.

31.  If for any reason the Promotion is not capable of running as planned, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoters, which corrupt or affect the administration, security, fairness or integrity or proper conduct of the Promotion, the Promoters may as their sole discretion, cancel, terminate, modify or suspend the Promotion (including these Terms) or invalidate any affected entries, subject to any direction given by a government authority or under any government regulation.

32.  Neither Promoter accepts responsibility for any tax liabilities that may arise from winning a Prize.

33.  By entering this Promotion:

(a)     Eligible Entrants agree to assign all rights in their entry to the Promoters and consent to the Promoters (or the agencies/companies associated with the Promoters) using the entry in any manner a Promoter wishes (including modifying, adapting or publishing the entry, whether in original or modified form, in whole or in part or not at all) in marketing, advertising and promotional materials, on the Promoters’ websites and social media platforms or in any other manner as determined by the Promoters, without payment to the Eligible Entrant (of royalties, compensation or otherwise) on a perpetual, world-wide and irrevocable basis.

(b)     if requested, Eligible Entrants agree to declare to the Promoters all past, current or potential conflicts of interest (if any) or any serious social misconduct or behaviour that in a normal person’s opinion may compromise the integrity or diminish the good name and reputation of the Promoters or their products, brands, is contrary to law or otherwise inappropriate.

34.  These Terms are dated 5 February 2026.

Use of Personal Information

1.     By entering the Promotion, an Eligible Entrant, understands and agrees that each Promoter may use that Eligible Entrant’s names, postal and/or email address for that Promoter’s marketing and communication purposes. Any personal information Eligible Entrants provide will be treated confidentially and in accordance with each Promoter’s Privacy statement at

2.     By entering the Promotion, an Eligible Entrant understands and agrees that CMC Markets NZ may use the details provided on the Entry Form, including but not limited to name, phone number, email address for CMC Markets NZ’s marketing and communication purposes. Any personal information Eligible Entrants provide will be handled in accordance with CMC Markets NZ Privacy Statement at https://www.cmcmarkets.com/en-nz/privacy.

3.     Information about Eligible Entrants is used by the Promoters to assess and process registration in the Promotion. If an Eligible Entrant does not provide the required information, the Promoters cannot process the registration and the Eligible Entrant’s entry will not be valid. All entries become the property of each Promoter and will be entered into a database. Information emanating from the Eligible Entrant’s participation in the Promotion is used by the Promoters, and their agencies associated with this Promotion, for the determination of the Winners and distribution of the Prize, if any, awarded to an Eligible Entrant.

4.     A request to access, update or correct any personal information should be directed to each Promoter.

5.     Eligible Entrants consent to publishing their name in the results section of the Blues Rugby website or any other digital channels of each Promoter. Neither Promoter will be held responsible for any loss of reputation, status or otherwise in connection with an Eligible Entrant's entry into the Promotion.

6.     Eligible Entrants consent to the Promoters using the Eligible Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by either Promoter.
